1. Legal Notice and Privacy Policy

Protection of Personal Data:

In compliance with the Federal Law on Protection of Personal Data Held by Private Parties, the data collected will be used exclusively for booking management, billing, and direct communication. No data will be shared with third parties without your explicit consent.

Intellectual Property:

All content on this website, including design, photographs of the apartments, the Azul Mar logo, text, and graphics, is protected by the Federal Copyright Law. Total or partial reproduction, distribution, or use is strictly prohibited without prior written authorization from the owner.

Limitation of Liability:

Azul Mar Diving & Lodge is not responsible for external technical failures, internet service interruptions, or damages resulting from computer viruses. Likewise, the establishment is not responsible for the loss of valuables, money, or jewelry left inside the apartments or common areas.

2. Terms and Conditions of Sale (T&Cs)

Booking and Payment Procedure:

  • To confirm a reservation, a deposit of $1,000 MXN per room is required. Without this payment, space availability is not guaranteed.
  • The remaining balance must be paid in full at the time of check-in.
  • Payment Methods: Cash, bank transfers, debit, and credit cards.
  • Prices are subject to change without notice until the reservation is confirmed with the deposit.

Cancellation, Refund, and Force Majeure Policies:

  • Cancellation: In the event of cancellation by the guest, the reservation deposit is non-refundable.
  • Force Majeure: In situations involving hurricanes, natural disasters, or alerts issued by civil protection, reservations may be rescheduled subject to availability, but will not be eligible for cash refunds.

Liability for Damages:

The guest is responsible for any damage caused to the infrastructure, furniture, or equipment of the apartments due to misuse. Azul Mar reserves the right to charge for repairs or replacements before or after check-out.

3. Internal Lodging Regulations

  • Schedules: Check-in at 3:00 PM; Check-out at 10:00 AM.
  • Late Check-out: Subject to availability until 3:00 PM at a cost of $400 MXN (must be requested in advance with the concierge).
  • Cleaning Service:
    Weekly cleaning is included (for stays of 7 days or more), including linen changes. Extra cleaning services are available for $500 MXN.
  • Energy Conservation:
    Please turn off the air conditioning and lights when leaving the apartment.

Pool Area:

  • Mandatory use of the shower before entering the pool.
  • Glass bottles or glasses are strictly prohibited in the pool area.
  • Do not leave personal items around the pool.
  • Pool towels are available upon request (free of charge). Please do not use room towels at the pool.

Coexistence and Quiet Hours:

The use of the pool and patio after 10:00 PM must be in total silence to respect the rest of other guests.

Prohibitions:

  • Smoking is not allowed inside the apartments.
  • Visitors not registered in the reservation are not permitted without authorization from the concierge.
  • The use of illicit substances is strictly prohibited on the premises.

Security and Keys:

  • Always keep your apartment and the main gate locked.
  • In case of loss, a $150 MXN fee will be charged for the replacement of the key set.

Trash:

Please deposit your waste in the blue bin located at the corner of the street.

4. Jurisdiction

For the interpretation and fulfillment of these terms, the parties submit to the applicable provisions of the United Mexican States. In the event of a dispute, they agree to submit to the jurisdiction of the Federal Consumer Protection Agency (PROFECO) and the competent courts in the state of Quintana Roo, expressly waiving any other jurisdiction.
